A former Delaware charter school principal awaiting sentencing on federal theft charges is facing more trouble with the law.

Noel Rodriguez, who was accused of embezzling more than $145,000 from the Academy of Dover, faces sentencing March 30 after pleading guilty to federal program theft.

But a court filing by a pretrial services officer indicates that Rodriguez has a Feb. 28 court date in North Carolina on a drunken-driving charge.

Court records indicate that Rodriguez was arrested by Wake County police on Nov. 24, just four days after he entered his guilty plea in the embezzlement case, and charged with DUI.

According to police, Rodriguez hit another vehicle, was very unsteady and had slurred speech. His blood alcohol content was measured at 0.22 percent, almost three times the legal limit.
